TV2Africa is a business in the media industry that provides streaming of live television channels, live events, radio channels, video on demand and media download services.
Your use of the Service is expressly conditioned on your compliance and consent with these Terms of Service. By accessing or using the Service, you are indicating that you agree to be bound by these Terms of Service. TV2AFRICA reserves the right to amend, discontinue, limit, disable, terminate or cancel any feature of the Service.
TV2AFRICA is only providing you an online video service offering a selection of television channels and radio stations and other content (collectively, the "Content"). Our video service, the Content, our player for viewing the Content (the "Video Player") and any other features, tools, applications, materials, or other services offered from time to time by TV2AFRICA in connection with its business, however accessed, are referred to collectively as the TV2AFRICA Services.
In order to use the Services, you must receive data connectivity services from your service provider. The cost of the data connectivity service may vary among service providers. It is your responsibility to review such costs and to determine whether you wish to bear such costs or not. In particular, you further acknowledge that the cost of such data connectivity service may rise significantly when roaming internationally. Therefore, you are advised to consider the cost of using the Service, depending on your location at any particular time.License
Subject to your full compliance with all of the terms and conditions of this Agreement, TV2AFRICA or its content providers hereby grants you a limited, personal, non-commercial, non-exclusive, revocable, non-sub licensable, non-transferable, non-assignable license to download, install and use the Application for the sole purpose of your personal use of the Application in connection with provision of the Service by TV2AFRICA.
TV2AFRICA is entitled, without any liability, to refuse, restrict, limit, suspend, interfere or interrupt the Service or any part thereof, without any prior notice to you, for the repair, improvement or upgrade of the Service or for any of the reasons for termination as mentioned below.
You may not make any use of the Service in whole or in part that is not expressly permitted by this Agreement. Without limiting the generality of the foregoing, you shall not: (1) copy, modify, translate, reverse engineer, decompile or disassemble the Service or create derivative works based thereon; or (2) install the Application onto a server so that it is accessible via a public network; or (3) delete or modify any attributions, legal notices or other proprietary designations in the Software or any part thereof.
Any such forbidden use shall immediately and automatically terminate your license to use the Service, without derogating from any other remedies available to TV2AFRICA.
You agree that TV2AFRICA owns and retains all rights to the TV2AFRICA Services. You further agree that the Content you access and view as part of the TV2AFRICA Services is owned or controlled by TV2AFRICA. The TV2AFRICA Services and the Content are protected by copyright, trademark, and other intellectual property laws.Registration & Account with TV2Africa
TV2AFRICA services require you to sign up. If you choose to sign up, you must submit a valid e-mail address and select password during the registration process. You must provide accurate information when creating your account. You are solely responsible for the safeguard of your account password that you use to access any secure areas of the Services. You agree not to disclose your password to anyone.
You agree to take sole responsibility for any activities or actions under your password, whether or not you have authorized such activities or actions. You shall immediately notify TV2AFRICA of any unauthorized use of your password. TV2AFRICA reserves the right to refuse providing services to any user, or to delete accounts created by users who appropriate the name, likeness, email address or other personally identifiable information of another individual.
You may choose to sign up for a TV2AFRICA account using Facebook. Please be aware that by choosing to connect your TV2AFRICA account to social media sites, including Facebook or to use our social features, you are agreeing to these social terms ("Social Terms") and are consenting to the collection, use and sharing of information about you with us and others, such as your name, location and contact information, birthdate, gender, and other information.
You should be at least 18 years of age or the age of majority in your country, to become a member of the TV2AFRICA service. Individuals less than 18 years of age may only use the service under the supervision of an adult.Subscriber’s Corner and Payment
Ongoing Subscription. You must have internet access and provide TV2AFRICA with a current, valid, accepted method of payment (as may be updated from time to time, "Payment Method") to use the TV2AFRICA service. If you choose a monthly subscription, your TV2AFRICA subscription will continue in effect on a period-to-period basis unless and until you cancel your subscription or we terminate it. We will bill the subscription fee on monthly basis (30 days starting from the date of purchase) as per the Payment Method. You must cancel your subscription before its expiration limit in order to avoid billing of the next period’s subscription fees. If TV2AFRICA does not receive the payment at the end of the current expiration period, your subscription will end and will only resume once you make a payment through the available Payment Method. In this case, your next period will begin on the day TV2AFRICA receives payment through the Payment Method.2. Differing Subscriptions and Pay per View
We may offer a number of subscription plans, including special promotional plans or subscriptions with differing conditions and limitations. We reserve the right to call the subscription plan whatever we want and you have the option to subscribe to the plan when it is available. You can find specific details regarding your subscription with TV2AFRICA by visiting our app(s) and clicking on the "My Profile > Subscriptions" page. We may also offer Free subscriptions which will have an advertising component as well as Pay per View for events and content downloads.3. Trial Subscription
We offer trial package for certain period without any payment ("Trial Subscription"). We reserve the right, at our sole discretion, we may withdraw or modify a Trial Subscription at any time without any prior notice to you and with no liability to the widest extent permitted under Local Country Law. If we feel you’re abusing our trial subscription offer, we may at our discretion decide to charge for it.
You may choose to begin monthly subscription before your Trial subscription expires. In this case, your monthly subscription will begin when you make a payment, and you agree to forgo the remaining period of your Trial Subscription. You may also choose to begin monthly subscription precisely when, or after your Trial subscription expires. Your monthly subscription will still begin when you make a payment. To view the specific details of your subscription, including monthly subscription price and end date of your Trial subscription period, visit the "My Profile > Subscriptions" page available to you in application across all platforms.4. Billing
a- Recurring Billing: By starting your monthly subscription through the designated Payment Method, you authorize us to charge you a periodic subscription fee at the then current rate of your selected subscription, and any other charges you may incur in connection with your use of the TV2AFRICA service to the Payment Method. You acknowledge that the amount billed for each billing period may vary from period to period for reasons that may include differing amounts due to promotional offers, including promotional code redemption, and/or changing or adding a plan, and you authorise us to charge through the Payment Method for such varying amounts, which may be billed per billing period in one or more charges. Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Africa Enterprise Media Group bank account, the details of which are provided via the payment gateway. Africa Enterprise Media Group (AEMG) is the holding company for TV2AFRICA and AEMG will reflect on your invoices for TV2AFRICA service.
b- Price Changes: We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion.
d- No Refunds: Payments are nonrefundable and TV2AFRICA does not commit to provide refunds or credits for any reason, including partially used periods. Also note that the minimum time needed to process the cancellation is 48 hours from the next billing cycle. To cancel, visit "My Profile > Subscriptions" in our app(s) and cancel your subscription.
e- Cancellation: Whilst we are sure it is likely to be a source of great regret, you may cancel your TV2AFRICA subscription at any time. If you cancel, you’ll still be able to watch our content on TV2AFRICA until the end of your subscription period. We don’t provide refunds or credits for any unused partial month subscription periods. If you have subscribed to a monthly subscription, you will need to cancel your subscription on the "My Profile > Subscriptions" page of our app(s). If you cancel your subscription, your access to the content will be locked at the end of your current billing period and you won’t be able to access our content anymore. To see when your subscription plan will expire, visit the "My Profile > Subscriptions" page of our app(s).
f- Card acquiring and security: Card transactions will be acquired for Africa Enterprise Media Group via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
g- Customer details separate from card details: Customer details will be stored by Africa Enterprise Media Group separately from card details which are entered by the client on DPO PayGate’s secure site.

h- Payment options accepted
Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Africa Enterprise Media Groups' bank account which manages all TV2AFRICA payments, the details of which will be provided on request.
TV2AFRICA shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). j- Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).Delivery Policy
Once you are registered with TV2AFRICA and your account goes live with a Trial Subscription. You will be sent a confirmation email with your account details. You are now ready to proceed to use our Services and can access the content offered by TV2AFRICA.THIRD PARTY WEBSITES AND CONTENT
TV2AFRICA has not and cannot review all of the material, information and content available on or by means of third party websites and webpages to which the Service links and transmit information to the website (“Third Party Content”), and cannot therefore be responsible for such Third Party Content. By using TV2AFRICA, TV2AFRICA does not represent or imply that it endorses such website or webpage or any of the content thereon. You are responsible for taking precautions as necessary to protect yourself and your device(s) from viruses, worms and other harmful or destructive content. TV2AFRICA disclaims any responsibility whatsoever for any harm resulting from your use of third party websites and webpages.

As a condition to your use of the Service, you agree not to use the Service to infringe any intellectual property rights. We reserve the right to terminate the accounts or to block access to the Service to any users who infringe any intellectual property rights.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU. TV2AFRICA may terminate your access to all or any part of the Service at any time, with or without cause, or with or without notice, effective immediately, such termination may result in the destruction of all information and data associated with your account. If you wish to terminate your account, you may do so by deleting the Application from your device and removing the Application from “Your Apps” in the App Center of your Facebook account. If you terminate your account, your profile will be removed from the Service, however, deletion may not be immediate and TV2AFRICA may continue keeping your personal information in its records for billing purposes, audits and other administrative purposes.GOVERNING LAW & JURISDICTION
ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE APPLICATION MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.GENERAL
